TERMS AND CONDITIONS

1. GENERAL PROVISIONS
These Terms and Conditions govern the use of the website and online store of Higeja d.o.o., Ptujska ulica 19, Ljubljana, as well as the terms and conditions for purchasing courses and products offered by Higeja d.o.o. through its online store.

By using the website and submitting an order, the customer confirms that they have read, understood and accepted these Terms and Conditions.
These Terms and Conditions are published on the Higeja website and are available to the customer before placing an order.
2. ONLINE STORE AND OFFER
Higeja d.o.o. enables customers to purchase various services and products through its online store.
The offer may include, in particular:
educational courses,
massage products,
massage tables,
other products published in the online store.
The offer, prices and other information relating to individual products or courses are published alongside the relevant product or service in the online store.
Higeja reserves the right to change its offer, prices and other terms of sale. For each individual purchase, the terms and price applicable at the time the order is placed shall apply.
3. PURCHASE AND CONCLUSION OF CONTRACT
Purchases may also be made without registering a user account, where the online store allows this.
The customer selects the desired product or course, enters the required information, selects a payment method and confirms acceptance of these Terms and Conditions before placing the order.
After successfully submitting an order, the customer receives an order confirmation at the email address provided during the purchase.
The contract between Higeja d.o.o. and the customer is concluded when the order is confirmed or when payment has been successfully completed, depending on the selected payment method and the online store procedure.
The customer is responsible for the accuracy of the information provided when placing the order.
4. PRICES AND PAYMENT
All prices are stated in euros (EUR) and include VAT, unless expressly stated otherwise for a particular product or service.
The customer pays the price applicable at the time the order is placed.
Payment in the online store is possible using the available payment methods indicated during the purchase process.
Card payments are processed through the payment service provider Stripe.
For course purchases, the full amount is payable at the time of purchase. Instalment payments are not available unless Higeja expressly determines otherwise for a particular case.
After completing the purchase, the customer receives an invoice at the email address provided with the order.
5. COURSE PURCHASES
By purchasing a course, the customer obtains the right to participate in the selected course under the conditions stated for that particular course.
A place on the course is reserved after successful payment.
The number of places on individual courses may be limited. Once capacity has been reached, registration for that particular date is no longer possible.
Details regarding the location, date, time, duration and other characteristics of each course are stated with the individual course or on the website.
6. CANCELLATION OR CHANGE OF COURSE BY THE PARTICIPANT
If a participant is unable to attend a course after purchasing it, they must inform Higeja d.o.o. as soon as possible at info@higeja.si.
The possibility of changing the course date, transferring the registration or receiving a refund depends on the circumstances of each individual case and the consumer rights provided by applicable law.
In individual cases, Higeja may allow participation to be transferred to another date or another course, provided that the relevant conditions are met and places are available.
If a participant is unable to attend the course, they should notify Higeja as soon as possible.
7. RIGHT OF WITHDRAWAL FOR ONLINE PURCHASES
For distance contracts, consumers have the right to withdraw from the contract in cases and under the conditions provided by the applicable legislation of the Republic of Slovenia.
As a general rule, consumers have the right to withdraw from a distance contract within 14 days without giving a reason. However, the law also provides for exceptions to this right.
For services, a consumer may request that the provision of the service begin before the expiry of the 14-day withdrawal period. In such cases, specific statutory rules regarding withdrawal and any proportional payment for services already provided shall apply.
If a particular course or service falls under a statutory exception to the right of withdrawal, the right of withdrawal shall be assessed in accordance with applicable legislation.

8. CANCELLATION OF A COURSE BY HIGEJA
Higeja reserves the right to change the date or cancel a course for objective reasons, including reasons beyond its control.
If Higeja cancels a course, the participant will be informed using the contact details provided during registration.
In the event of cancellation by Higeja, the participant will, in accordance with applicable legislation, be offered an appropriate solution, such as a refund or another suitable arrangement.
9. ONLINE STORE – PHYSICAL PRODUCTS
Higeja also sells physical products through its online store.
The product will be delivered to the address provided by the customer when placing the order.
Delivery costs and the delivery method are stated during the purchase process or with the individual order.
The delivery time depends on product availability, the delivery method and other circumstances.
If a product cannot be delivered within the expected period due to unforeseen circumstances, Higeja will inform the customer accordingly.
10. RIGHT OF WITHDRAWAL FOR PRODUCT PURCHASES
When purchasing goods through the online store, consumers have the right to withdraw from the contract in accordance with applicable legislation.
Consumers may withdraw from the contract within the statutory period without giving a reason, except in cases where the law provides for an exception.
When exercising the right of withdrawal, the customer must return the product in accordance with Higeja’s instructions. Statutory rules regarding return costs, reimbursement and any reduction in the value of the goods shall apply.
In the event of a valid withdrawal, Higeja will refund the payment within the statutory deadlines and under the applicable conditions.
11. COMPLAINTS AND NON-CONFORMITY OF GOODS
Customers may submit complaints, claims relating to non-conformity of goods or other questions concerning an order to:

When exercising rights relating to non-conformity of goods, the applicable consumer protection legislation shall apply.
When submitting a claim, the customer should provide as much information as possible about the order and the issue and, where possible, attach photographs or other documentation that may assist in processing the claim.
12. GIFT VOUCHERS
Higeja may offer gift vouchers.
A gift voucher is valid for one year from the date of issue unless otherwise stated for a particular voucher.
A gift voucher cannot be exchanged for cash.
The value of a gift voucher cannot be refunded or paid out, except where applicable legislation provides otherwise.
The terms of use of the gift voucher are specified at the time of purchase or on the gift voucher itself.
13. COURSE MATERIALS AND COPYRIGHT
Materials used or provided by Higeja or its instructors as part of the courses may be protected by copyright.
Without permission, such materials may not be reproduced, distributed, publicly published or used contrary to the purpose for which they were provided.
Participants may not record lectures or other course content without the prior permission of Higeja or the instructor where such recording is prohibited.
14. CERTIFICATES
After successfully completing a course, the participant may receive a certificate if the conditions for issuing it have been met.
The conditions for issuing a certificate may be specified for each individual course.
Higeja may charge a fee for reissuing a lost or damaged certificate.
15. PARTICIPANT RESPONSIBILITIES
Participants must follow the instructions of instructors and organizers and behave in a manner that does not endanger themselves or other participants.
For practical courses, participants must follow all safety and practical training instructions.
Higeja is not responsible for participants’ personal belongings, except where Higeja’s liability is established by applicable law.
The provisions of this section do not affect the statutory rights or liability of Higeja.
16. PERSONAL DATA
Higeja processes personal data in accordance with applicable legislation and its Privacy Policy published on the website.
The use of cookies is governed by the Cookie Policy published on the website.
Customers are provided with information regarding the processing of personal data before or during the relevant procedure whenever required by applicable law.
17. COMPLAINTS AND DISPUTE RESOLUTION
Higeja strives to resolve any complaints and disputes with customers amicably.

Disputes shall be resolved in accordance with the applicable laws and regulations of the Republic of Slovenia, particularly consumer protection legislation.
18. CHANGES TO THE TERMS AND CONDITIONS
Higeja reserves the right to amend these Terms and Conditions due to changes in legislation, business practices, its offer or other reasons.
For each individual purchase, the Terms and Conditions published and accepted at the time the order was placed shall apply, unless applicable legislation provides otherwise.
The current version of the Terms and Conditions is always published on the Higeja website.
19. FINAL PROVISIONS
If any provision of these Terms and Conditions is invalid or unenforceable, this shall not affect the validity of the remaining provisions.
For matters not regulated by these Terms and Conditions, the applicable legislation of the Republic of Slovenia shall apply.
These Terms and Conditions enter into force on the date of publication on the website.
